Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes conduct that is prohibited when accessing or using the service operated by Beacon LLC (“Beacon,” “we,” “us,” or “our”) at facilitypresence.com, cal.facilitypresence.com, and associated applications and APIs (the “Service”). This AUP is part of, and incorporated by reference into, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.
1. Your Responsibility
You are responsible for your use of the Service and for the conduct of anyone who uses it through your account, including staff and authorized sub-users of an Operator account. You must comply with all applicable laws and with this AUP.
2. Prohibited Conduct
You may not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Access or attempt to access the Service, accounts, or data without authorization, or circumvent any authentication, security, or rate-limiting measure;
- Interfere with, disrupt, or impose an unreasonable load on the Service, including via denial-of-service attacks, malware, or excessive automated requests;
- Reverse engineer, decompile, or disassemble the Service, or attempt to derive its source code, except to the extent this restriction is prohibited by law;
- Copy, modify, distribute, sell, sublicense, or create derivative works of the Service or its content except as expressly permitted;
- Scrape, crawl, harvest, or use automated means to collect data from the Service without our prior written consent;
- Use the Service or any data obtained from it to train or develop machine-learning or artificial-intelligence models, or deploy unauthorized AI agents against the Service;
- Use the Service to build, benchmark, or assist a competing product, or publish performance benchmarks without our consent;
- Send spam or unsolicited messages, or violate laws governing electronic communications, marketing, or telemarketing;
- Upload, post, or transmit content that is unlawful, infringing, defamatory, harassing, hateful, obscene, or that violates the privacy or intellectual-property rights of others;
- Impersonate any person or entity, or misrepresent your affiliation, identity, or origin (including masking your identity or IP address to evade restrictions);
- Store or transmit material that contains viruses, worms, or other harmful code, or data you are not authorized to handle;
- Remove, obscure, or alter any proprietary or copyright notices.
3. Content Standards for Operators
Operators who collect member information, run programs, or process payments through the Service must do so lawfully, must accurately describe their offerings, pricing, and refund policies, and must obtain any consents required to share member data with the Service. Operators are responsible for the content they publish and for their dealings with Members.
4. Reporting Violations
If you become aware of a violation of this AUP, report it to hello@facilitypresence.com.
5. Enforcement
We may investigate suspected violations and may remove content, throttle or restrict functionality, and suspend or terminate accounts that violate this AUP, with or without notice, consistent with our Terms of Service. We may also cooperate with law enforcement where appropriate.
6. Changes to this AUP
We may update this AUP from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service after the changes take effect constitutes acceptance.
